TERMS OF USE — TransCall

Please read these Terms carefully before using TransCall.
1. ACCEPTANCE OF THE TERMS
By installing or using the TransCall mobile application (the “App”), you agree to these Terms of Use (the “Terms”). If you do not agree with the Terms, do not use the App.
The Terms apply to all users of the App and form a legally binding agreement between you and the operator of the TransCall service (“we”, “us”).
2. THE SERVICE
TransCall is a real-time phone call translation service. You speak your own language through the App; the person you call hears the translation spoken in their language on an ordinary phone, and the other way round. The service exists to help people communicate with institutions and with each other across a language barrier.
How a call works
- The call is placed through the App (over the internet) to an ordinary phone number. The person you call needs no app.
- Your verified phone number is shown to them as the caller ID.
- At the beginning of the conversation, a short notice is automatically played to them in their language, stating that the conversation is going through an automatic translator and that a delay is possible. You undertake not to attempt to disable or circumvent this notice.
- Trusted third-party service providers are engaged to process the call. Your speech is passed to them in real time solely in order to perform the translation.
Quality and availability
We aim for high availability but do not guarantee uninterrupted operation. Translation quality depends on the language pair, the quality of the phone line, the internet connection and background noise. Translation is performed automatically (by artificial intelligence) and may contain errors. There is a natural delay of a few seconds between a sentence and its translation.
TransCall is a tool to assist communication. It is not a certified (sworn) translator and does not replace professional legal, medical or financial translation. For legally significant situations, use a professional translator.
Supported languages
The list of available languages is shown in the App and may change over time. Some language pairs translate better than others; for certain languages the quality of recognising the other party’s speech may be limited.
⚠️ Emergency calls
TransCall is not intended for, and must not be used for, emergency calls (112 or any other emergency service). The App does not guarantee transmission of your location and does not replace ordinary telephone service. In an emergency, call 112 from an ordinary phone.
The reasons are technical rather than formal: short emergency numbers are not routed through an international carrier; the emergency service will not receive your location, and the call will not be routed to the nearest dispatch centre; translating speech takes several seconds, and an inaccurate translation would be unacceptable in such a situation.
What the App does. If you enter an emergency number, the App will not dial it itself but will offer to open your device’s ordinary phone dialler with the number already entered — you only need to confirm the call. Such a call goes through your mobile operator’s network with all its capabilities, including location, and works even with a zero TransCall balance and without internet access.
3. YOUR ACCOUNT
Using the service requires registration with a phone number:
- You enter your number and confirm it with a code sent by SMS. The confirmed number becomes your caller ID for calls.
- You may register only your own number, one that you own and use. Registering someone else’s number is prohibited.
- Each account is assigned an identifier (for example, TC-100001) — quote it when contacting support; you do not have to give your phone number.
- You are responsible for keeping your phone and access to the App secure, and for all activity and charges made under your account.
- You must be at least 18 years old to register and to top up your balance.
If you believe someone else is using your account, contact us immediately (see “Contacts”).
4. ACCEPTABLE USE
You undertake to use TransCall only for lawful purposes. You must not use the App in order to:
- breach applicable law in any jurisdiction;
- harass, intimidate, abuse or harm other people;
- impersonate another person or organisation;
- commit or facilitate fraud, extortion, spam, or intrusive or automated cold-calling;
- record or store conversations without the consent of the parties where such consent is required by law (see below);
- circumvent or interfere with the App’s safety features, including the notice played to the other party about the translator;
- reverse-engineer or decompile the service, or attempt to extract its source code and components;
- resell or commercially distribute the service without our written permission.
A breach may result in immediate suspension or closure of your account.
Transcripts and recording laws
The App shows subtitles of the conversation and keeps a call history with transcripts locally on your device, for your convenience. Complying with your country’s laws on recording conversations is your responsibility. We do not provide legal advice on these matters.
5. BALANCE AND PAYMENT
Prepaid balance
Calls are paid for from the prepaid balance of your account. The balance is topped up by bank card through a payment provider. No free starting credits are provided.
Charging
- The price per minute depends on the country and the type of destination number (mobile or landline). Current rates are shown in the App (the “Rates” section); the price of a specific call is shown before it begins.
- Charging is per minute; a partial minute is rounded up to a full one. Charging starts when the other party answers.
- If your balance is not enough for even one minute, the call will not start. If the balance runs out during a conversation, the call ends automatically.
- We may change rates; changes apply to future calls and do not affect calls already made.
Refunds
Charges for completed calls are non-refundable. An unused balance may be refunded on your request within a reasonable time, less payment processing fees, unless mandatory consumer protection law provides otherwise.
6. DATA AND PRIVACY
- The speech of both parties is processed in real time to perform the translation and is not stored on our server as recordings.
- Call history and transcripts are stored locally on your device; you can delete them in the App at any time.
- The server stores the data needed to run the service and to bill correctly: your number, account identifier, balance, a call log (destination number, duration, cost) and top-up history.
- Card details are handled by the payment provider; we do not receive or store your full card number.
Details are set out in the Privacy Policy; in case of conflict, the Privacy Policy prevails on matters of data processing.
7. INTELLECTUAL PROPERTY
The App, the name, logo, design and technology of TransCall belong to the operator of the service and are protected by intellectual property law. You keep the rights to the content of your conversations. By sending us feedback and suggestions, you allow us to use them to improve the service without compensation.
8. DISCLAIMER OF WARRANTIES
TransCall is provided “as is” and “as available”, without warranties of any kind, express or implied:
- we do not warrant that translations will be accurate, complete or fit for any particular purpose;
- we do not warrant error-free, secure or uninterrupted operation of the App, or that any given number can be reached;
- TransCall does not replace professional translation services.
You use the App at your own risk. We are not liable for misunderstandings, errors or consequences arising from inaccuracies of automatic translation.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damage (including loss of data, revenue or business reputation) arising from use of the App.
Our aggregate liability for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim, or 10 euros, whichever is greater. Mandatory consumer rights provided by law are not limited by this.
10. TERMINATION
You may stop using TransCall at any time by deleting the App; to delete your account and be refunded the remaining balance, contact us.
We may suspend or close your account without prior notice in the event of a breach of these Terms, fraudulent activity, or where required by law. If an account is closed for a breach of the Terms, the remaining prepaid balance is not refunded, to the extent permitted by law.
The sections on intellectual property, disclaimer of warranties, limitation of liability and governing law survive termination.
11. GOVERNING LAW
These Terms are governed by the law of Finland. Disputes shall be resolved through good-faith negotiation; failing agreement, by a competent court in Finland. If you are a consumer, you retain the rights granted by the mandatory provisions of the law of your country of residence, including the right to turn to consumer protection authorities.
12. CHANGES TO THE TERMS
We may update these Terms; when we do, the “Last updated” date changes. We will notify you of significant changes through the App. Continuing to use the service after updated Terms are published means you accept them.
